Hotel Terms and Conditions

The following Terms and Conditions apply to all reservations.

In these Terms and Conditions the following definitions apply:

“The Agreement” is your Booking Confirmation, Registration and the Terms and Conditions; 
“The Company” is Luss Estates t/a Loch Lomond Arms Hotel; 
“The Hotel” is the Loch Lomond Arms Hotel, Luss, Loch Lomond, Argyll; 
“The Owner” is the Owner of the Hotel; 
“The Booking(s)” includes accommodation, functions and any event bookings made; 
“The Guest(s)” is the person, company, organisation or other body responsible for making the Booking

1. Bookings

1.1 Guests may book in advance or on arrival.

1.2 Rooms are subject to availability and the Company reserves the right to refuse any Booking for good reason.

1.3 Although payment is generally required on departure, there may be occasions when the Guests are required to fully prepay or provide a deposit at the time of the Booking, or, on arrival at The Hotel.

1.4 You can only make a booking if you are 18 years old or over.

1.5 A child is classed as a person under 16 years of age. If a person under 16 arrives at the hotel, they will not be permitted to stay unless accompanied by an adult. Should this child’s parent/guardian wish the child to stay in a room unaccompanied, the parent/guardian accepts all responsibility for that child’s safety and behaviour in the room.

1.6 By requesting a booking, you warrant that:

(a) You are legally capable of entering into binding contracts; and

(b) You are at least 18 years old

1.7 If you book 5 or more rooms at the Hotel it will be classed as a "Multiple Booking". If you request a Multiple Booking these terms and conditions do not apply, please ask for the Group terms and Conditions.

2. Charges

2.1 The prices given upon booking are per room, per night. Meals are not included (excepting breakfast, where applicable).

2.2 A minimum length of stay, deposit, cancellation charge and other conditions may apply to certain rates, as specified.

2.3 The VAT breakdown shown is indicative based on the current rate of VAT, and the expected VAT treatment of the goods or services, and may change depending on the actual tax point of the invoice, and the VAT treatment of the goods and services purchased at that date.

2.4 Price lists for additional items, such as Restaurant meals and Room Service, are on display at relevant locations within the Hotel and are available on request.

2.5  All items and furniture in your room is the property of Luss Estates. We reserve the right to charge you the full replacement cost for any item or piece of furniture removed from your room. These include, but are not limited to:

Hairdryers                           £40.00

Remote Controls                  £40.00

2.6 If you or any members of your party cause any damage to the hotel interiors, room interiors or soft furnishings, we reserve the right to charge you for the cost of repair of any such damage.

 3. Payment

3.1 You will be asked to provide a credit card (or debit card) at the time of the Booking to secure your reservation. 3.2 Where a deposit or full payment is required in advance; by Booking you are authorising the debiting of the card provided.

3.3 We accept the following methods of payment: Credit Cards: MasterCard, Visa Debit Cards: Visa / Delta and Visa / Electron.
3.4 The Guest must pay all outstanding charges on departure from the Hotel.

 4. Cancellation/ Non-Arrival

4.1 All reservations are taken in good faith, and all rooms are held all night. Please advise the Hotel in advance, if your arrival time will be after 10pm.

4.2 Cancellations are free of charge up until 12noon, day prior to arrival. After this time, a charge, equivalent to one nights stay, will be deducted from the card given on booking.

4.3 In the event of a non-arrival, a charge, equivalent to one nights stay, will be deducted from the card given on booking.

 5. Change of Booking Details

5.1 Reservations may be amended in line with the Booking conditions accepted at the time of the original reservation/s. Changes may be made subject to those conditions and any deposit / prepayment held is subject to those booking terms at the time of the original reservation.

5.2 Where the Booking permits, any change to the arrival date, departure date or room type is subject to availability at the time the change is requested and may result in a possible rate change.

 6. Arrival and Departure

6.1 Guests may check-in at any time from 2.00 p.m. on the day of arrival.

6.2 All rooms that have been secured by credit / debit card or prepaid at the time of booking will be held until 8am on the following day.

6.3 Any non-secured reservation will be held until 12noon on the day of arrival, at which time the hotel is entitled to re-let the room, unless the guest has notified the hotel of a late arrival.

6.4 On the day of departure we kindly ask all guests to vacate their rooms by 11.00am (unless a later departure is stated and agreed in writing as part of your booking).

6.5 Late check-out after this time can be requested subject to availability and will be charged at an hourly rate at the discretion of the hotel.

 7. Rooms and Accessibility

7.1 Each of our rooms is unique and as a result the rooms may vary in character, size and in the number of guests that can be accommodated. It is your responsibility to verify the details of a room when you request a booking to ensure that it meets your requirements.

7.2 All of our rooms have a maximum adult occupancy as follows:

(a) Single: 1 adult only

(b) Small Double or Small Twin: 2 adults only

(c) Four Poster or Superior Room: 3 persons only

7.3 A limited number of Z beds and cots are available at a charge of £10 per Z bed and free of charge for cots. Please speak to the Hotel directly regarding which rooms are suitable for these items. We only have a limited number of rooms available which will have the space for these items, and cannot guarantee that these rooms will be available unless pre-booked.

7.4 Some of our rooms are suitable for guests with disabilities. Suitable rooms are listed at the hotel. These rooms have been independently inspected. If you or any member of your party require special facilities please advise us when you request a booking.

7.5 The Hotel operates a system of assisted evacuation for disabled visitors, in the event of a fire. Please ensure you advise reception upon booking if you require any assistance in such an event.

 8. Guest Behaviour

8.1 You are expected to conduct yourself at all times in an orderly and acceptable manner and not to disrupt the quiet enjoyment of other guests.

8.2 We reserve the right to immediately terminate your booking and the booking of any members of your party if we (acting reasonably) deem your conduct to be in breach of this clause.

8.3 Conduct that we reasonably consider inappropriate and in breach of these terms and conditions includes but is not limited to:

(a) creating an inappropriate level of noise;

(b) drunken or unruly behaviour; and/or

(c) any behaviour which other guests or staff find offensive or dangerous in any way.

We will at all times act reasonably when making any determination under this clause.

8.4 In the event that we terminate your booking pursuant to this clause, you will be required to leave your accommodation immediately. You will be held liable for any damage or loss caused by you or a member of your party. Full payment for any such damage or loss must be paid prior to your departure. If you fail to make payment, you will be responsible for meeting any claims (including legal costs) subsequently made against us as a result of your actions together with all costs we incur in pursuing any claim against you.

8.5 Our obligations to you come to an end when the booking is terminated pursuant to this clause. We will have no obligation to refund you for lost accommodation and we will not pay for any expenses or costs incurred as a result of the termination.

 9. Parking

Cars can be parked anywhere around the Hotel where there is a parking bay, and this is free of charge. These are public parking areas, and as such, the Hotel accepts no responsibility for loss, theft or damage to/from cars. Owners leave their cars at their own risk.

 10. Smoking

10.1 In line with government legislation, all of our rooms are non-smoking.

10.2 Should we find evidence of smoking in your room, we will make a charge for deep cleaning, this can be applicable after your departure. This charge will be the cost of two nights accommodation plus £75.00.

 11. Pets

The Hotel does not accept any pets, excepting guide dogs

12. Soiling

Soiling will be charged per costs incurred, including loss of revenue due to the room being unfit for purpose. The minimum charge will be £100.00

 13. Hotel Events

13.1 Please be aware that at certain times throughout the year the Hotel may host weddings, events and parties, which you may feel would be an intrusion on your break. Please contact the hotel directly in advance of your stay for further information.

13.2 The Hotel also adjoins the Loch Lomond Arms Public House. Please note you may be able to hear noise from the pub in your room. This may include loud music. Please ask at reception for specific details on any noise and environmental issues at the time of your stay, as the Hotel will not be held responsible for any disturbance or inconvenience caused if this procedure is not followed in writing.

 14. Insurance

14.1 The Company’s liability where accommodation is booked for Guest belongings is generally limited under the Hotel Proprietors Act 1956.

14.2 The Company maintains appropriate insurance cover where the hotel is liable for any injury or loss or damage suffered by our Guests.

 15. If you have a problem

In the unlikely event that you have a problem during your stay you must bring it to the attention of the hotel management at the time to ensure that we have an opportunity to rectify the problem during your stay.

 16. Use of Personal Information

Any personal information given to us when booking, or during your stay, will only be used to tailor your stay to your needs. We will not give your personal details to any third parties. We may use your details for in house marketing, if you would prefer us not to do this, then please let us know as soon as possible. For our full Privacy Policy, please refer to our Privacy Policy, available on the website, or from Hotel reception.

17. CCTV

In the public areas of the Loch Lomond Arms Hotel and some staff areas CCTV is in operation and video recordings may be made. This activity is carried out for security and service reasons for the better management of the Loch Lomond Arms Hotel and security for all its Clients and staff.

18. Licensing and Statutory Regulations

The Company, Hotel, functions and conferences within it are subject to Statutory Regulations including those relating to fire precautions and entertainment. The regulations must be strictly observed and a copy is available from the Hotel.  The provisions of the Licensing Act 1964 as amended must be observed.

 19. Liability

19.1 This clause sets out the entire financial liability of the Company (including any liability for the acts or omissions of its employees, agents, consultants and subcontractors) to the Guest in respect of:

any breach of this Agreement; and any representation, statement or tortious act or omission (including negligence) arising under or in connection with this Agreement.

19.2 All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from this Agreement.

19.3 Nothing in this Agreement limits or excludes the liability of the Company:

for death or personal injury resulting from negligence; or

for any damage or liability incurred by the Guest as a result of fraud or fraudulent misrepresentation by the Company.

19.4 Subject to clause 19.2. and clause 19.3 and

the Company shall not be liable for any special, indirect, consequential or pure economic loss including but not limited to loss of profits, loss of business; depletion of goodwill and/or similar losses.

the Company’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of this Agreement shall be limited to the value of the Agreement.

19.5 The Company does not accept liability for loss or damage to any object, equipment, furniture, stock or any other property brought onto the premises by the Guest or persons authorised by the Guest.

The Company will endeavour to assist Guests with storage of their equipment etc but it excludes liability for the loss or damage of those items.

 20. Hotel Proprietors Act 1956

This Agreement does not affect any rights, which the Guest may have under the Hotel Proprietor’s Act 1956, where this act applies

 21. Force Majeure

21.1 The Company shall not be in breach of this Agreement if it does not provide the services under this Agreement due to the following circumstances:

(i) Industrial action by the Company’s employees

(ii) Industrial action by the staff of one of the Company’s suppliers

(iii) Fire, lighting, explosion, riot, civil commotion, malicious damage, extreme weather conditions, storm, flood, burst pipes, earthquake , terrorism and the Hotel being damaged or destroyed.

(iv) Postal bookings which do not reach the Company

(v) Breakdown of machinery, or any failure to supply the Hotel with gas, electricity, water and so on, outside the control of the Company.

If any of the above occurs the Company will do its best to avoid any inconvenience to you or your Guests.

22. Assignment

The Company shall have the ability to assign, subcontract or transfer any of its rights or obligations under the Agreement as it sees fit.

23. Third Party Rights

None of the terms of the Agreement are intended to be enforceable by any third party nor is it intended that this Agreement will confer any right on any person pursuant to the Contracts (Rights of Third Parties) Act 1999.

24. Variation

24.1 We reserve the right to change the Terms and Conditions at any time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities

24.2 Any changes to the Terms and Conditions will be effective for all bookings made under Contracts entered into after the change is published on the Website. You should check the Terms and Conditions posted on the Website before each booking – they may have changed since your last visit.

25. Waiver

Failure to exercise, or any delay in exercising, any right or remedy provided under this Agreement by law to the Company shall not constitute a waiver of that (or any other) right or remedy, nor shall it preclude or restrict any further exercise of that (or any other) right or remedy.

26. Severance

If any provision of the Agreement (or part of any provision) is found by a court to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of this Agreement, and the validity and enforceability of the other provisions of this Agreement shall not be affected.

27. Right of Set Off

The Company shall have the ability to deduct any sums owed to it by the Guest  against any sums it owes whether any such sum is present or future (whensoever arising), liquidated or unliquidated, under this Agreement or not.  Any exercise by the Company of its rights under this clause shall be without prejudice to any other rights or remedies available to it under this Agreement or otherwise.

28. Jurisdiction

The Agreement shall be governed by the laws of Scotland and the Courts of Scotland shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Agreement or its subject matter or formation

The following Terms and Conditions apply to all reservations of five rooms or more.

In these Terms and Conditions the following definitions apply:

(b) You are at least 18 years old

2. Charges

2.1 The prices given upon booking are per room, per night. Meals are not included (excepting breakfast, where applicable) unless agreed by the Hotel in writing.

2.2 The VAT breakdown shown is indicative based on the current rate of VAT, and the expected VAT treatment of the goods or services, and may change depending on the actual tax point of the invoice, and the VAT treatment of the goods and services purchased at that date.

2.3 Price lists for additional items, such as Restaurant meals and Room Service, are on display at relevant locations within the Hotel and are available on request.

2.4. All items and furniture in the Guest’s room is the property of Luss Estates. We reserve the right to charge the Agent the full replacement cost for any item or piece of furniture removed from the Guest’s room, and this can be done after departure. These include, but are not limited to:

Hairdryers                           £40.00

Remote Controls                  £40.00

2.5. If any of the Agent’s Guests cause any damage to the hotel interiors, room interiors or soft furnishings, we reserve the right to charge the Agent for the cost of repair of any such damage. This can be applicable after departure.

3. Payment

3.1. Full payment is required a minimum of seven days in advance of arrival.

3.2. We accept the following methods of payment: Credit Cards: MasterCard, Visa Debit Cards: Visa / Delta and Visa / Electron. Cheque. BACS.
3.3. The individual Guest must pay all outstanding charges not payable by the Agent, on departure from the Hotel.

4. Cancellation/ Non-Arrival

4.1. All reservations are taken in good faith, and all rooms are held all night. Please advise the Hotel in advance, if your arrival time will be after 10pm.

4.2. Cancellations will be charged per room and as follows:

  • 14 days prior to the event or less – 100% of the Total Price;
  • 21-15 days prior to the event – 50% of the Total Price;
  • 28-22 days prior to the event – 25% of the Total Price;
  • 29 days or more prior – 0%

5. Change of Booking Details

5.1. Reservations may be amended in line with the Booking conditions accepted at the time of the original reservation/s.

5.2. Changes may be made subject to those conditions and any deposit / prepayment held is subject to those booking terms at the time of the original reservation.

5.3. Where the Booking permits, any change to the arrival date, departure date or room type is subject to availability at the time the change is requested and may result in a possible rate change.

6.2. All rooms prepaid at the time of booking will be held until 8am on the following day.

If your Guest fails to make payment, the Agent will be responsible for full payment, and the Agent will be responsible for meeting any claims (including legal costs) subsequently made against us as a result of your Guests actions together with all costs we incur in pursuing any claim against you.

8.5. Our obligations to you and your Guest come to an end when the booking is terminated pursuant to this clause. We will have no obligation to refund you or your Guest for lost accommodation and we will not pay for any expenses or costs incurred as a result of the termination.

9. Parking

9.1. Cars and small coaches can be parked around the Hotel where there is a parking bay, and this is free of charge. These are public parking areas, and as such, the Hotel accepts no responsibility for loss, theft or damage to/from cars. Owners leave their cars at their own risk.

9.2. For larger coaches, please contact the Hotel for details of where to park. At no point whatsoever, will the Hotel accept liability for loss, theft or damage to/from your coach, regardless of where it is parked.

10. Smoking

In line with government legislation, all of our rooms are non-smoking. Should we find evidence of smoking in your Guest’s room, we will make a charge for deep cleaning, this can be applicable after your departure. This charge will be the cost of two nights accommodation plus £75.00. If we cannot claim this from your Guest, we will advise the Agent of the Guest’s details, and the Agent will be responsible for payment of this charge, and the subsequent securing of the monies from the Guest.

11. Pets

The Hotel does not accept any pets, excepting guide dogs

If we cannot claim this from your Guest, we will advise the Agent of the Guest’s details, and the Agent will be responsible for payment of this charge, and the subsequent securing of the monies from the Guest.

Failure to exercise, or any delay in exercising, any right or remedy provided under this Agreement by law to the Company shall not constitute a waiver of that (or any other) right or remedy, nor shall it preclude or restrict any further exercise of that (or any other) right or remedy.

26. Severance

If any provision of the Agreement (or part of any provision) is found by a court to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of this Agreement, and the validity and enforceability of the other provisions of this Agreement shall not be affected.

27. Right of Set Off

The Company shall have the ability to deduct any sums owed to it by the Guest  against any sums it owes whether any such sum is present or future (whensoever arising), liquidated or unliquidated, under this Agreement or not.  Any exercise by the Company of its rights under this clause shall be without prejudice to any other rights or remedies available to it under this Agreement or otherwise.

28. Jurisdiction

The Agreement shall be governed by the laws of Scotland and the Courts of Scotland shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Agreement or its subject matter or formation
